Terms and Conditions

1. Acceptance and eligibility

These Terms govern use of the Apparel You website, custom-design service, client stores, accounts, and orders. By creating an account, submitting an order, approving a proof or quote, or using a client store, you agree to these Terms and the policies linked from them. You must be at least 18 or act with the involvement and permission of a parent or legal guardian.

2. Accounts

You must provide accurate information and protect access to your email account and sign-in links. You are responsible for activity performed through your account unless you promptly notify us of unauthorized access. We may suspend access reasonably believed to be fraudulent, abusive, unlawful, or harmful to the service or another person.

3. Custom orders

Website prices for custom products are estimates unless expressly identified as final. A custom order begins in Awaiting Admin Review. Apparel You reviews artwork, placement, print size, product availability, quantity, delivery, and pricing before issuing a final proof or quote. Payment remains locked until the order is confirmed, and production does not begin until the required artwork approval and payment have been received.

Minimum quantities vary by product and are shown in the design tool. You are responsible for checking the final proof, including spelling, colours, sizing, placement, and other design details. Approval authorizes production based on that proof.

4. Client-store orders and mixed carts

Client-store merchandise is printed to order and does not require custom-order review unless we contact you about an issue. It may proceed to the normal payment step when submitted. A cart containing both custom and client-store items is separated into linked orders so the client-store portion is not delayed by custom review.

5. Prices, discounts, and payment

Prices are shown in Trinidad and Tobago dollars (TTD) unless stated otherwise. Delivery fees and any other applicable charge will be disclosed before payment or in the confirmed quote. Payments may be processed by WiPay. An order is not paid merely because a payment attempt was started; payment must be confirmed.

Only one Apparel You discount code may be applied per order. A code may be limited by an expiry period or a maximum number of uses, may apply only to eligible items, and has no cash value. Discounts are calculated on eligible merchandise before packaging and delivery charges and do not reduce those charges. For a custom order, a displayed saving remains an estimate until the final quote is confirmed. We may cancel or correct a discount affected by error, misuse, or unauthorized distribution before the order is paid.

A cart-recovery, second-purchase, or repeat-customer offer may be limited to the intended recipient, a qualifying prior order, particular products, a stated period, and one redemption. The offer communication or linked promotion will state the material eligibility, expiry, exclusions, and combination rules.

6. Artwork and intellectual property

You keep ownership of artwork you own. By uploading or submitting artwork, you give Apparel You a limited licence to store, reproduce, adjust for production, create proofs, manufacture the requested goods, and keep reasonable order records. You confirm that you own the material or have permission to use it and that it does not infringe intellectual-property, privacy, publicity, or other rights.

We may reject unlawful, hateful, threatening, defamatory, sexually exploitative, deceptive, or infringing material, or material we reasonably cannot produce safely or reliably. You are responsible for claims arising from material you supplied without the necessary rights.

7. Delivery, collection, cancellations, and returns

Delivery is available only within Trinidad and Tobago. Delivery and collection are governed by the Delivery & Collection Policy. Cancellations, damaged or incorrect goods, and available remedies are governed by the Returns & Refunds Policy. Those policies form part of these Terms.

8. Service availability and liability

We may update, correct, suspend, or discontinue website features. Product colours and scale may appear differently across screens, and stock or supplier availability can change before an order is confirmed. Nothing in these Terms excludes or limits any right, remedy, warranty, or liability that cannot lawfully be excluded or limited, including liability arising from fraud or wilful misconduct.

To the extent permitted by law, Apparel You is not responsible for indirect or consequential loss, loss caused by inaccurate customer instructions, or delay outside our reasonable control. Apparel You’s total aggregate liability arising from or connected with a particular order will not exceed the amount actually paid to Apparel You for the affected order. This cap applies regardless of the form of claim, but does not reduce any mandatory consumer remedy or apply where a greater liability cannot lawfully be limited.

9. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Apparel You and its personnel from third-party claims, losses, liabilities, damages, and reasonable legal costs arising directly from: artwork, names, logos, photographs, instructions, or other material you supplied without the necessary rights or permissions; your unlawful or unauthorized use of the service; or your material breach of these Terms.

Apparel You will notify you within a reasonable time after becoming aware of a covered claim and will allow reasonable participation in its defence or settlement. You must not agree to a settlement that admits wrongdoing by, imposes an obligation on, or restricts Apparel You without our prior written consent. This indemnity does not apply to the extent a claim was caused by Apparel You’s negligence, fraud, wilful misconduct, or breach of these Terms, and it does not limit any mandatory consumer right or remedy.

10. Governing law and contact

These Terms are governed by the laws of Trinidad and Tobago. The parties should first try to resolve a concern directly and in good faith. Contact apparelyoutt@gmail.com with the relevant account email and order reference.
